Car Sale Agreement

A written record of a private used-car sale in Kenya — the buyer, seller, vehicle, price, condition and handover. It protects both sides and is useful evidence if a disagreement comes up later.

How to use this document

  • 1Fill in the parties, the vehicle's details (registration, chassis/VIN, engine number, mileage) and the agreed price and payment terms.
  • 2Record the condition (sold 'as is' unless you've agreed a written warranty) and exactly what's handed over.
  • 3Both parties sign in duplicate — keep one copy each — ideally with a witness.

Questions

Is a car sale agreement legally required in Kenya?

No — a sale can happen without one — but a written agreement protects both parties by recording what was agreed and helps if there's a dispute. It does not replace transferring ownership at NTSA.

Does signing a sale agreement transfer ownership?

No. The agreement records the sale; legal ownership is transferred separately through NTSA (see our Ownership Transfer Guide). Until that's done, the car stays in the seller's name.
